Amendment X

The 10th Amendment to The United States Constitution is as follows:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

The 10th Amendment to the U.S. Constitution is really quite simple and straightforward.  It was put in place as the ultimate check against the usurpation of power by the Federal Government.  Quite specifically it tells the Federal Government to carry out it’s responsibilities and duties, as enumerated in the preceding Constitutional Document, and nothing more.  Keep in mind, the Framers had just fought a long and bloody war to gain independence and freedom from King George III of England.  They were keenly aware of the dangers of too much power, centralized in the hands of too few, and the effects it could have on a nation.  It could be said that most of the original states would have had a tough time ratifying the U.S. Constitution had not this amendment been included in the original Bill of Rights.

The 10th Amendment, while not having been repealed, is under attack in a more insidious way.  It is being ignored.  It is being ignored by a Democrat controlled House of Representatives, a Democrat controlled Senate, and an out of control Democrat-Socialist in the White House.  The lust for power and the central control putsch of this current regime is breathtaking to behold.  By what Constitutional authority does this cabal force Obama-care down the throats of the American people, clearly against their will?   By what Constitutional authority does this cabal propose to exercise more power grabs in the form of Cap and Trade legislation, Global Warming initiatives, more Stimulus(?) packages, Wall Street bailouts, banker bailouts, journalist bailouts, car companies, etc.  The list goes on and on, ad nauseum.  It is imperative that we, as a nation and as individual states, support and elect good conservative people who understand the original intent of the limited role of government in our lives.  The GOP lost it’s way after Ronaldus Maximus and carries lots of the blame for the mess that we’re in today.

There is hope, however.  This awakening has started as demonstrated by the lawsuit that A.G. McMaster joined in on behalf of the good people of South Carolina to have the courts overturn Obama-care.  The suit, in part, is based on the new law’s multiple violations of the 10th Amendment.  The State of Montana has a new law protecting the manufacture, sale, and possession of lawful firearms within the State borders.  This is a safeguard against an unconstitutional Federal infringement of the people of that state’s right to keep and bear arms.  We have the tools in place to put the Federal Government back in it’s lawful place, we just need elected officials who will have the courage and the convictions to use the tools provided to them by the U.S. Constitution.

The Framers of the United States Constitution were brilliant and visionary men who, I believe, were inspired by the Lord our God to write the governing documents that have made this country the most free and the most prosperous nation in the history of all mankind.  This has been the case for over two hundred years.  After the elections in November of 2010 and 2012, we need to (1) fumigate both houses of Congress and the White House and (2) hold these newly elected leaders accountable for their actions and ensure that such a blatantly unconstitutional power grab never happens again on our watch.  We owe this debt to our forefathers and have this responsibility for future generations.

  6. The 10th is my favorite amendment. John Marshall’s opinion in McColloch v. Maryland was the started the trend that has led to the states’ power being eroded, and I’m glad people like Henry are trying to take it back.
